The fact that a resolution authority commences a consultation process with a competent authority while determining whether an institution is ‘failing or likely to fail’ should be considered by the competent authority as a significant event prompting assessment as to whether early intervention measures should be applied towards the institution in order to maintain or restore its viability and prevent its failure. Such a situation may occur when the resolution authority is empowered to determine that an institution is ‘failing or likely to fail’ pursuant to Article 32 of Directive 2014/59/EU.
