Article 40 Liability of ACER

Article 40 1.
|
The contractual liability of ACER shall be governed by the law applicable to the contract in question. Any arbitration clause contained in a contract concluded by ACER shall be subject to the jurisdiction of the Court of Justice.

Article 40 2.
|
In the case of non-contractual liability, ACER shall, in accordance with the general principles common to the laws of the Member States, make good any damage caused by it or by its staff in the performance of their duties.

Article 40 3.
|
The Court of Justice shall have jurisdiction in disputes over compensation for damages referred to in paragraph 2.
|
|
Article 40 4.
|
The personal financial liability and disciplinary liability of ACER's staff towards it shall be governed by the relevant provisions applying to ACER's staff.
