Artikel 67

Änderung der Richtlinie (EU) 2019/904

Die Richtlinie (EU) 2019/904 wird wie folgt geändert:

1. 

Artikel 2 wird wie folgt geändert:

a) 

Absatz 2 erhält folgende Fassung:

„(2)  
Im Falle einer Kollision dieser Richtlinie mit den Richtlinien 94/62/EG oder 2008/98/EG ist die vorliegende Richtlinie maßgeblich, es sei denn, in der Verordnung (EU) 2025/40 des Europäischen Parlaments und des Rates ( *1 ) ist etwas anderes bestimmt.
b) 

Folgender Absatz wird angefügt:

„(3)  
Im Falle einer Kollision des Artikels 4 dieser Richtlinie mit Artikel 25 Absätze 1 und 6 der Verordnung (EU) 2025/40 in Bezug auf Einwegkunststoffverpackungen gemäß Anhang V Nummer 3 der genannten Verordnung hat Artikel 25 Absätze 1 und 6 der genannten Verordnung Vorrang.“
2. 

In Artikel 6 Absatz 5 werden die Buchstaben a und b ab dem 1. Januar 2030 oder drei Jahre nach Inkrafttreten des in Artikel 7 Absatz 8 der Verordnung (EU) 2025/40 genannten Durchführungsrechtsakts, je nachdem, welcher Zeitpunkt der spätere ist, gestrichen.

In Artikel 13 Absatz 1 wird Buchstabe e ab dem 1. Januar 2030 oder drei Jahre nach Inkrafttreten des in Artikel 7 Absatz 8 der Verordnung (EU) 2025/40 genannten Durchführungsrechtsakts, je nachdem, welcher Zeitpunkt der spätere ist, gestrichen.

4. 

Artikel 13 Absatz 3 erhält folgende Fassung:

„(3)  
Die Kommission überprüft die gemäß diesem Artikel übermittelten Daten und Informationen und veröffentlicht einen Bericht über die Ergebnisse ihrer Überprüfung. Der Bericht enthält eine Bewertung der Organisation der Datenerhebung und der Informationssammlung, der Datenquellen und der von den Mitgliedstaaten angewandten Methoden sowie der Vollständigkeit, Verlässlichkeit, Aktualität und Kohärenz dieser Daten und Informationen. Die Bewertung kann auch spezifische Verbesserungsvorschläge umfassen. Der Bericht wird nach der ersten Daten- und Informationsübermittlung durch die Mitgliedstaaten und anschließend alle vier Jahre erstellt.“
5. 

Teil B des Anhangs wird wie folgt geändert:

a) 

Die Nummern 7, 8 und 9 erhalten folgende Fassung:

„7. 

Lebensmittelverpackungen aus expandiertem Polystyrol (EPS) oder extrudiertem Polystyrol (XPS), d. h. Behältnisse wie Boxen (mit oder ohne Deckel) für Lebensmittel, die

a) 

dazu bestimmt sind, unmittelbar vor Ort verzehrt oder als Take-away-Gericht mitgenommen zu werden,

b) 

typischerweise aus der Verpackung heraus verzehrt werden, und

c) 

ohne weitere Zubereitung wie Kochen, Sieden oder Erhitzen verzehrt werden können,

einschließlich Verpackungen für Fast Food oder andere Speisen zum unmittelbaren Verzehr, ausgenommen Getränkebehälter, Teller sowie Tüten und Folienverpackungen (Wrappers) mit Lebensmittelinhalt;

8. 

Getränkebehälter aus expandiertem Polystyrol (EPS) oder extrudiertem Polystyrol (XPS) einschließlich ihrer Verschlüsse und Deckel;

9. 

Getränkebecher aus expandiertem Polystyrol (EPS) oder extrudiertem Polystyrol (XPS) einschließlich ihrer Verschlüsse und Deckel;“

b) 

Die folgenden Nummern werden angefügt:

„10. 

Schrumpffolie, die in Flughäfen oder Bahnhöfen zum Schutz von Gepäck während der Beförderung verwendet wird;

11. 

Chips aus Polystyrol und anderen Kunststoffen, die zum Schutz verpackter Waren während des Transports und der Handhabung verwendet werden;

12. 

Mehrpack-Kunststoffringe, die als Umverpackung im Sinne von Artikel 3 Absatz 1 Nummer 6 der Verordnung (EU) 2025/40 verwendet werden.“

‘2.   Where this Directive conflicts with Directive 94/62/EC or 2008/98/EC, this Directive shall prevail unless provided otherwise by Regulation (EU) 2025/40 of the European Parliament and of the Council (*1).

(b)

the following paragraph is added:

‘3.   Where Article 4 of this Directive conflicts with Article 25(1) and (6) of Regulation (EU) 2025/40 as regards single-use plastic packaging listed in point (3) of Annex V to that Regulation, Article 25(1) and (6) of that Regulation shall prevail.’

Article 67 (2)

in Article 6(5), points (a) and (b) are deleted from 1 January 2030 or 3 years from the date of entry into force of the implementing act referred to in Article 7(8) of Regulation (EU) 2025/40, whichever is the latest;
Article 67 (3)

in Article 13(1), point (e) is deleted from 1 January 2030 or 3 years from the date of entry into force of the implementing act referred to in Article 7(8) of Regulation (EU) 2025/40, whichever is the latest;
Article 67 (4)

in Article 13, paragraph 3 is replaced by the following:

‘3.   The Commission shall review the data and information reported in accordance with this Article and publish a report on the results of its review. The report shall assess the organisation of the collection of the data and information, the sources of data and information and the methodology used in Member States as well as the completeness, reliability, timeliness and consistency of those data and information. The assessment may include specific recommendations for improvement. The report shall be drawn up after the first reporting of the data and information by the Member States and every 4 years thereafter.’
Article 67 (5)

Part B of the Annex is amended as follows:

(a)

points 7, 8 and 9 are replaced by the following:

‘(7)

Food containers made of expanded (EPS) or extruded (XPS) polystyrene, i.e. receptacles such as boxes, with or without a cover, used to contain food which:

(a)

is intended for immediate consumption, either on-the-spot or take-away;

(b)

is typically consumed from the receptacle; and

(c)

is ready to be consumed without any further preparation, such as cooking, boiling or heating,

including food containers used for fast food or other meal ready for immediate consumption, except beverage containers, plates and packets, and wrappers containing food;

(8)

Beverage containers made of expanded (EPS) or extruded (XPS) polystyrene, including their caps and lids;

(9)

Cups for beverages made of expanded (EPS) or extruded (XPS) polystyrene, including their covers and lids;’

(b)

the following points are added:

‘(10)

Shrink wrap that is used in airports or train stations for the protection of luggage during transport;

(11)

Chips of polystyrene and other plastics that are used to protect packed goods during transport and handling;

(12)

Multi-pack plastic rings used as grouped packaging as defined in Article 3(1), point 6, of Regulation (EU) 2025/40.’.
