Article 5 3.

Member States may provide that requests to coordinate civil works made by an undertaking that provides, or is authorised to provide, public electronic communications networks to an undertaking owned or controlled by public sector bodies and providing, or authorised to provide, public electronic communications networks, may be deemed to be unreasonable in the event that the civil works contribute to the deployment of VHCNs, provided that those VHCNs are located in rural or remote areas, are owned or controlled by public sector bodies, and are operated on a wholesale-only basis.
