Article 7 3
3. Without prejudice to the national arrangements resulting from Article 4(5) and to Article 5(1), second subparagraph, of this Regulation, with a view to establishing whether an entity complies with the essential requirements regarding financial robustness, liability, insurance cover, ownership and organisational structure listed in point 7 of Annex VIII to Regulation (EU) 2018/1139 and with the requirements set out in the implementing acts referred to in Article 43 of that Regulation, national supervisory authorities shall:

(a)

assess the compliance of applicants for certification, in accordance with Article 41(2) of Regulation (EU) 2018/1139, with the essential requirements regarding financial robustness, liability, insurance cover, ownership and organisational structure listed in point 7 of Annex VIII of that Regulation and with the requirements set out in the implementing acts referred to in Article 43 of that Regulation and provide its assessment to the competent authority referred to in Article 62 of that Regulation;

(b)
|
pursuant to Article 5(2) of this Regulation, perform the oversight of holders of a certificate issued in accordance with Article 41 of Regulation (EU) 2018/1139, with respect to the compliance with the essential requirements regarding financial robustness, liability, insurance cover, ownership and organisational structure listed in point 7 of Annex VIII to that Regulation and with the requirements set out in the implementing acts referred to in Article 43 of that Regulation.
