Transmission system operators shall propose and, after approval by the regulatory authority, implement an incentive-based oversubscription and buy-back scheme in order to offer additional capacity on a firm basis. Before implementation, the regulatory authority shall consult the regulatory authorities of adjacent Member States and take account of the adjacent regulatory authorities’ opinions. Additional capacity refers to the firm capacity offered in addition to the technical capacity of an interconnection point calculated pursuant to Article 6(1).
