Article 13 6.

Following a substantiated request by a competent authority of a Member State and taking into account the objectives of this Regulation, the Commission shall assess the availability of reclaimed and recycled fluorinated greenhouse gases falling within the scope of paragraphs 4 and 5. Where the Commission’s assessment points to a verified shortage of a reclaimed and recycled fluorinated greenhouse gas, the Commission may, exceptionally, by means of implementing acts, authorise an exemption from the prohibitions set out in paragraph 4 or 5, for up to 4 years, to the extent needed to address the shortage identified. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 34(2).
