Article 37 2.When requiring that a product be able to measure the energy it consumes or its performance in relation to other relevant product parameters referred to in Annex I while in use, pursuant to Article 4(6), point (c)(i), the Commission shall take into account the following criteria:
(a)
the usefulness of in-use data for end users to understand and manage the energy use or performance of the product;
(b)
the technical feasibility of recording in-use data;
(c)
the need to avoid a disproportionate administrative burden for economic operators, in particular for SMEs; and
(d)
the need to ensure that no data allowing the identification of individuals or allowing the inference of individuals’ behaviour are collected. 1. Vue d’ensemble
