For this purpose, competent authorities should take the necessary steps to gain a full understating of the statement of non-opposition by the third-country competent authority submitted in the application, or to obtain a statement of non-opposition to the establishment of the TCB directly from the third-country competent authority as laid down in Part III. Competent authorities remain free to come to a different conclusion than the declaration of the third-country competent authority, also taking into account the overall assessment of the application.
