Paragraph 9 shall not apply to electrical switchgear for which it has been established pursuant to ecodesign requirements adopted under Directive 2009/125/EC that its life cycle CO2 equivalent emissions would be lower than those of equivalent equipment which meets the relevant ecodesign requirements and would comply with the global warming potential limits in paragraph 9.
