5. pants

Operatoru sniegtie ziņojumi

1.  Katra apsaimniekošanas objekta, kurā tiek veiktas viena vai vairākas I pielikumā minētās darbības virs piemērojamiem jaudas sliekšņiem, kas minēti šajā pielikumā, operatori paziņo katru gadu savai kompetentajai iestādei par apjomiem kopā ar norādēm par to, vai informācijas pamatā ir turpmāk minētie mērījumi, aprēķini vai novērtējums:

a) jebkuras II pielikumā minētās piesārņojošās vielas emisijas gaisā, ūdenī vai zemē, kurām pārsniegts II pielikumā minētais attiecīgais slieksnis;

b) pārneses ārpus teritorijas bīstamiem atkritumiem, kas pārsniedz 2 tonnas gadā, vai sadzīves atkritumiem, kas pārsniedz 2 000  tonnu gadā, jebkurai reģenerācijas vai apglabāšanas darbībai, izņemot 6. pantā minētās apglabāšanas darbības “attīrīšana augsnē” un “iesūknēšana”, attiecīgi norādot ar “R” (reģenerācija) vai “D” (apglabāšana), vai atkritumi ir paredzēti reģenerācijai vai apglabāšanai, un bīstamo atkritumu pārrobežu pārvedumiem – atkritumu reģenerētāja vai apglabātāja vārds (nosaukums) un adrese, kā arī faktiskā reģenerācija vai apglabāšanas vieta;

c) pārneses ārpus teritorijas jebkurām II pielikumā minētām piesārņojošām vielām notekūdeņos, kas paredzēti attīrīšanai, pārsniedzot II pielikuma 1.b slejā noteikto slieksni.

Katra tāda apsaimniekošanas objekta operatori, kurā tiek veiktas viena vai vairākas I pielikumā minētās darbības virs tajā noteiktajiem piemērojamiem jaudas sliekšņiem, elektroniski paziņo savai kompetentajai iestādei informāciju, kurā saskaņā ar 7. panta 2. punktā minēto formātu norāda apsaimniekošanas objektu, ja vien šī informācija jau nav kompetentās iestādes rīcībā.

▼B

Ja norādīts, ka dati ir balstīti uz mērījumiem vai aprēķiniem, ziņo par to analītisko un/vai aprēķināšanas metodi.

Saskaņā ar šā punkta a) apakšpunktu ziņojot par II pielikumā minētajām emisijām, iekļauj informāciju par visām emisijām no visiem I pielikumā minētajiem avotiem, kas atrodas apsaimniekošanas objekta teritorijā.

2.  Informācija, kas minēta 1. punktā, ietver informāciju par emisijām un pārnesēm, kas ir visu ar nodomu veikto, nejaušo, ierasto un neierasto darbību kopsumma.

Sniedzot šo informāciju, operatori, ja vien tas ir iespējams, sniedz visu informāciju, kas ir saistīta ar nejaušām noplūdēm.

3.  Katra apsaimniekošanas objekta operators ar noteiktu periodiskumu apkopo informāciju, kas nepieciešama, lai noteiktu apsaimniekošanas objekta emisijas un pārneses ārpus teritorijas, kas pakļautas ziņojuma sniegšanas prasībām saskaņā ar 1. punktu.

4.  Gatavojot ziņojumu, attiecīgais operators izmanto vislabāko pieejamo informāciju, kas var ietvert monitoringa datus, emisiju faktorus, masas bilances vienādojumus, netiešu monitoringu vai citus aprēķinus, tehnisko pētījumu slēdzienus un citas metodes atbilstīgi 9. panta 1. punktam un saskaņā ar starptautiski atzītām metodēm, ja tās ir pieejamas.

5.  Katra attiecīgā apsaimniekošanas objekta operators saglabā dalībvalsts kompetentajām iestādēm pieejamus datu ierakstus, no kuriem ziņojumā sniegtā informācija, tika iegūta piecu gadu laikposmā, sākot no attiecīgā pārskata gada beigām. Šajos ierakstos arī apraksta datu apkopošanā izmantoto metodoloģiju.

(a)

releases to air, water and land of any pollutant specified in Annex II for which the applicable threshold value specified in Annex II is exceeded;

(b)

off-site transfers of hazardous waste exceeding 2 tonnes per year or of non hazardous waste exceeding 2 000  tonnes per year, for any operations of recovery or disposal with the exception of the disposal operations of land treatment and deep injection referred to in Article 6, indicating with ‘R’ or ‘D’ respectively whether the waste is destined for recovery or disposal and, for transboundary movements of hazardous waste, the name and address of the recoverer or the disposer of the waste and the actual recovery or disposal site;

(c)

off-site transfers of any pollutant specified in Annex II in waste water destined for waste-water treatment for which the threshold value specified in Annex II, column 1b is exceeded.
