Article 16 10.

Where the addressee does not comply with its obligations under a recognised European Production Order or European Preservation Order the enforceability of which has been confirmed by the enforcing authority, that authority shall impose a pecuniary penalty in accordance with Article 15. An effective judicial remedy shall be available against a decision to impose a pecuniary penalty.
