Predmet úpravy a ciele

1.  Touto smernicou sa stanovujú pravidlá ochrany fyzických osôb pri spracúvaní osobných údajov príslušnými orgánmi na účely predchádzania trestným činom, ich vyšetrovania, odhaľovania alebo stíhania alebo na účely výkonu trestných sankcií, vrátane ochrany pred ohrozením verejnej bezpečnosti a predchádzania takémuto ohrozeniu.

2.  Členské štáty v súlade s touto smernicou:

a) chránia základné práva a slobody fyzických osôb, najmä ich právo na ochranu osobných údajov, a

b) zabezpečia, aby výmena osobných údajov medzi príslušnými orgánmi v rámci Únie, ak sa takáto výmena vyžaduje podľa práva Únie alebo práva členského štátu, nebola obmedzená ani zakázaná z dôvodov súvisiacich s ochranou fyzických osôb pri spracúvaní osobných údajov.

3.  Táto smernica členským štátom nebráni, aby stanovili prísnejšie záruky, ako sú záruky stanovené v tejto smernici na ochranu práv a slobôd dotknutých osôb, pokiaľ ide o spracúvanie osobných údajov príslušnými orgánmi.

Article 1 1.
This Directive lays down the rules relating to the protection of natural persons with regard to the processing of personal data by competent authorities for the purposes of the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security.
Article 1 2.

In accordance with this Directive, Member States shall:

(a) 

protect the fundamental rights and freedoms of natural persons and in particular their right to the protection of personal data; and

(b) 

ensure that the exchange of personal data by competent authorities within the Union, where such exchange is required by Union or Member State law, is neither restricted nor prohibited for reasons connected with the protection of natural persons with regard to the processing of personal data.
Article 1 3.
This Directive shall not preclude Member States from providing higher safeguards than those established in this Directive for the protection of the rights and freedoms of the data subject with regard to the processing of personal data by competent authorities.
