Where the statement of non-opposition by the third-country competent authority(ies) set out in Part I, Section 1, paragraph (2), point (g) of these draft Guidelines is not submitted by the applicant head undertaking in the application due to justified reasons, competent authorities should contact the third country-authority of the applicant, intermediate and ultimate parent head undertaking as applicable, to obtain confirmation in writing that there are no grounds to oppose the establishment of the TCB.
