A.
Overfladeaktive stoffer og overfladeaktive stoffer indeholdt i vaske- og rengøringsmidler
1. Overfladeaktive stoffer og overfladeaktive stoffer indeholdt i vaske- og rengøringsmidler skal være bionedbrydelige som bestemt i overensstemmelse med kriterierne i punkt 2.
2. Overfladeaktive stoffer og overfladeaktive stoffer indeholdt i vaske- og rengøringsmidler anses for at gennemgå fuldstændig aerob bionedbrydning, hvis de opfylder et af følgende kriterier:
a)
Graden af bionedbrydelighed (mineralisering) er mindst 60 % inden for 28 dage målt efter en af følgende testmetoder:
i)
metode C.4-C, CO2-udviklingstest, beskrevet i del C, del IV, i bilaget til Kommissionens forordning (EF) nr. 440/2008 (

)
ii)
metode C.4-D, manometrisk respirometritest, beskrevet i del C, del V, i bilaget til forordning (EF) nr. 440/2008
iii)
metode C.4-E, closed bottle test, beskrevet i del C, del VI, i bilaget til forordning (EF) nr. 440/2008
iv)
metode C.4-F, MITI-test, beskrevet i del C, del VII, i bilaget til forordning (EF) nr. 440/2008.
b)
Graden af bionedbrydelighed (mineralisering) er mindst 70 % inden for 28 dage målt efter en af følgende testmetoder:
i)
metode C.4-A, DOC-elimineringstest, beskrevet i del C, del II, i bilaget til forordning (EF) nr. 440/2008
ii)
metode C.4-B, modificeret OECD-screeningtest, beskrevet i del C, del III, i bilaget til forordning (EF) nr. 440/2008.
Der anvendes ikke præadaptation, og der anvendes ikke princippet om tidagesvindue i nogen af de testmetoder, der er omhandlet i dette punkt.
3. De test, der er omhandlet i punkt 2, skal udføres af laboratorier, der opfylder mindst én af følgende betingelser:
a)
De overholder principperne for god laboratoriepraksis i Europa-Parlamentets og Rådets direktiv 2004/10/EF (

) eller internationale standarder, der er anerkendt som ækvivalente.
b)
De er akkrediteret i overensstemmelse med den standard for laboratorier, der er omhandlet i Europa-Parlamentets og Rådets forordning (EF) nr. 765/2008 (

Surfactants and surfactants contained in detergents shall be considered as achieving ultimate aerobic biodegradation if they meet one of the following criteria:

(a)

(i)
|
method C.4.-C CO2 evolution test, described in Part C, Part IV, of the Annex to Commission Regulation (EC) No 440/2008 (1);
|
|
(ii)
|
method C.4-D Manometric respirometry test, described in Part C, Part V, of the Annex to Regulation (EC) No 440/2008;
|
|
(iii)
|
method C.4-E Closed bottle test, described in Part C, Part VI, of the Annex to Regulation (EC) No 440/2008;
|
|
(iv)
|
method C.4-F M.I.T.I. test, described in Part C, Part VII, of the Annex to Regulation (EC) No 440/2008;
|
|
|
(b)
|
the level of biodegradability (mineralisation) is at least 70 % within 28 days measured in accordance with one of the following test methods:

(i)
|
method C.4-A DOC die-away test, described in Part C, Part II, of the Annex to Regulation (EC) No 440/2008;
|
|
(ii)
|
method C.4-B Modified OECD screening test described in Part C, Part III, of the Annex to Regulation (EC) No 440/2008.
|
Pre-adaptation shall not be used and the 10-day window principle shall not be applied in any of the test methods referred to in this point.

The tests referred to in point 2 shall be conducted by laboratories meeting at least one of the following conditions:
|
(a)
|
they comply with the principles of good laboratory practice provided for in Directive 2004/10/EC of the European Parliament and of the Council (2) or with international standards recognised as being equivalent;
|
|
(b)
|
they are accredited in accordance with the standard for laboratories referred to in Regulation (EC) No 765/2008 of the European Parliament and of the Council (3).
