Forbairt agus athchóiriú chritéir Éicilipéad an AE

1.  Tar éis dul i gcomhairle le BAEÉ, féadfaidh an Coimisiún, na Ballstáit, na comhlachtaí inniúla agus na geallsealbhóirí eile forbairt nó athchóiriú chritéir Éicilipéad an AE a thionscnamh agus a threorú. I gcás ina gcuirtear geallsealbhóirí eile den sórt sin mar cheannasaí ar threorú fhorbairt na gcritéar, ní mór dóibh saineolas a léiriú sa réimse táirgí, chomh maith leis an gcumas an próiseas a threorú go neodrach agus i gcomhréir le haidhmeanna an Rialacháin seo. I dtaca leis sin de, tabharfar tús áite do chuibhreannais a bhfuil breis agus leasghrúpa amháin iontu.

Déanfaidh an páirtí a thionscnóidh agus a threoróidh forbairt nó athchóiriú chritéir Éicilipéad an AE na doiciméid seo a leanas a thabhairt ar aird i gcomhréir leis an nós imeachta a leagtar amach i gCuid A d'Iarscríbhinn I:

(a) 

réamhthuarascáil;

(b) 

togra i gcomhair dréachtchritéar;

(c) 

tuarascáil theicniúil mar thacaíocht leis an togra i gcomhair dréachtchritéar;

(d) 

tuarascáil deiridh;

(e) 

lámhleabhar d'úsáideoirí ionchasacha Éicilipéad an AE agus do chomhlachtaí inniúla;

(f) 

lámhleabhar do na húdaráis a dhámhann conarthaí poiblí.

Cuirfear na doiciméid sin faoi bhráid an Choimisiúin agus faoi bhráid an BAEÉ.

2.  I gcás ina mbeidh critéir forbartha cheana féin faoi scéim eile éicilipéid a chomhlíonann na ceanglais do lipéid chomhshaoil chineál I EN ISO 14024 do ghrúpa táirgí nach bhfuil aon chritéir de chuid Éicilipéad an AE arna mbunú ina leith cheana, féadfaidh Ballstát ar bith ina bhfuil an scéim eile éicilipéid aitheanta, tar éis dul i gcomhairle leis an gCoimisiún agus le BAEÉ, a mholadh go bhforbrófaí na critéir sin faoi scéim Éicilipéad an AE.

Sna cásanna sin, féadfaidh feidhm a bheith ag an nós imeachta giorraithe maidir le forbairt critéar a leagtar síos i gCuid B d'Iarscríbhinn I ar choinníoll go ndearnadh na critéir atá beartaithe a fhorbairt i gcomhréir le Cuid A d'Iarscríbhinn I. Is é an Coimisiún, nó an Ballstát a mhol an nós imeachta giorraithe um fhorbairt na gcritéar, i gcomhréir leis an gcéad fhomhír, a threoróidh an nós imeachta sin.

3.  I gcás ina mbeidh gá le hathchóiriú neamhshubstaintiúil ar na critéir, féadfaidh feidhm a bheith ag an nós imeachta giorraithe um athchóiriú a leagtar síos i gCuid C d'Iarscríbhinn I.

4.  Faoin 19 Feabhra 2011, aontóidh an BAEÉ agus an Coimisiún ar phlean oibre lena n-áirítear straitéis agus liosta neamh-uileghabhálach de ghrúpaí táirgí. Sa phlean sin, breithneofar gníomhaíocht eile Comhphobail (e.g. i réimse an tsoláthair phoiblí ghlais), agus féadfar an plean sin a nuashonrú i gcomhréir leis na cuspóirí straitéiseacha is déanaí de chuid an Chomhphobail i réimse an chomhshaoil. Déanfar an plean sin a nuashonrú go tráthrialta.

Article 7 1.

Following consultation of the EUEB, the Commission, Member States, competent bodies and other stakeholders may initiate and lead the development or revision of EU Ecolabel criteria. Where such other stakeholders are put in charge of leading the development of criteria, they must demonstrate expertise in the product area, as well as the ability to lead the process with neutrality and in line with the aims of this Regulation. In this regard, consortiums consisting of more than one interest group shall be favoured.

The party which initiates and leads the development or revision of EU Ecolabel criteria shall, in accordance with the procedure set out in Part A of Annex I, produce the following documents:

(a) 

a preliminary report;

(b) 

a proposal for draft criteria;

(c) 

a technical report in support of the proposal for draft criteria;

(d) 

a final report;

(e) 

a manual for potential users of the EU Ecolabel and competent bodies;

(f) 

a manual for authorities awarding public contracts.

Those documents shall be submitted to the Commission and to the EUEB.
Article 7 2.

Where criteria have already been developed under another ecolabel scheme complying with the requirements of EN ISO 14024 type I environmental labels for a product group for which no EU Ecolabel criteria have been established, any Member State in which the other ecolabel scheme is recognised may, after consulting the Commission and the EUEB, propose those criteria for development under the EU Ecolabel scheme.

In such cases, the shortened criteria development procedure laid down in Part B of Annex I may apply provided that the proposed criteria have been developed in line with Part A of Annex I. Either the Commission or the Member State which, according to the first subparagraph, has proposed the shortened criteria development procedure shall lead that procedure.
Article 7 3.
Where a non-substantial revision of the criteria is necessary, the shortened revision procedure laid down in Part C of Annex I may apply.
Article 7 4.
By 19 February 2011, the EUEB and the Commission shall agree on a working plan including a strategy and a non-exhaustive list of product groups. This plan will consider other Community action (e.g. in the field of green public procurement) and may be updated according to the latest strategic objectives of the Community in the field of the environment. This plan shall be regularly updated.
