Article 42 3.
By 1 January 2018, Member States shall notify the rules regarding paragraphs 1 and 2 to the Commission and ESMA. Member States may decide not to lay down rules for administrative sanctions as provided for in paragraph 1 where the infringements referred to in that paragraph are subject to criminal sanctions under their national law. In that case, Member States shall communicate to the Commission and ESMA the relevant criminal law provisions along with the notification referred to in the first subparagraph of this paragraph. They shall notify the Commission and ESMA without delay of any subsequent amendment thereto.
