Article 33 1.

This Article shall apply to at least the following:

(a) 

persons who fail to register their distribution activities in accordance with Article 3;

(b) 

an insurance or reinsurance undertaking or insurance or reinsurance intermediary using the insurance or reinsurance distribution services of persons referred to in point (a);

(c) 

an insurance, reinsurance or ancillary insurance intermediary who obtained a registration through false statements or any other irregular means in breach of Article 3;

(d) 

an insurance distributor who fails to meet the provisions of Article 10;

(e) 

an insurance undertaking or insurance intermediary failing to comply with conduct of business requirements set out in Chapters V and VI, in relation to the distribution of insurance-based investment products;

(f) 

an insurance distributor who fails to comply with conduct of business requirements set out in Chapter V, in relation to any insurance product other than those referred to in point (e).
