4. Notwithstanding paragraph 1 of this Article and subject to the conditions set out in Article 2(5) of Regulation (EU) 2018/1139, Member States may allow the provision of air navigation services referred to in Article 2(3), point (c), of Regulation (EU) 2018/1139 in all or part of the airspace under their responsibility by the military without certification where the military offers such services primarily to aircraft movements other than general air traffic. In such cases, the Member State concerned shall inform the Commission and the other Member States of its decision.
