For purposes of assessing whether the issuer is ‘ unable or likely to be unable to fulfil its obligations’ under Regulation (EU) 2023/1114, the competent authority should have regard, inter alia , to the aspects listed in points (i) to (iii) of paragraph 84, exclusively relating to the requirements set out in Title III or Title IV, as applicable, of Regulation (EU) 2023/1114 and within the scope of supervision of the competent authority.
