5. Member States shall ensure that appropriate measures are in place to enable the competent authorities designated pursuant to paragraph 3 of this Article to obtain from credit purchasers or their representatives designated in accordance with Article 19, credit servicers, credit service providers to whom a credit servicer outsources credit servicing activities under Article 12, borrowers and any other persons or public authority, the information necessary to carry out the following:

(a)

assess ongoing compliance with the requirements laid down in the national provisions transposing this Directive;

(b)
|
investigate possible infringements of those requirements;
|
|
(c)
|
impose administrative penalties and remedial measures in accordance with the national provisions transposing Article 23.
