These guidelines apply to institutions, as defined in point 3 of Article 4(1) of Regulation (EU) No 575/2013. When the loan falls under the scope of Directive 2014/17/EU (the Mortgage Credit Directive, MCD), Section 5 applies to creditors, as defined in Article 4(2) of this directive, except for paragraph 93. When the loan falls under the scope of Directive 2008/48/EC (the Consumer Credit Directive, CCD), Section 5 applies to creditors, as defined in point (b) of Article 3 of that directive, except for paragraphs 93.
