Article 10 1

(a)

the ESG rating provider established outside the Union is authorised or registered as an ESG rating provider in the third country concerned and is subject to supervision in that third country;

(b)

the ESG rating provider established outside the Union has notified ESMA that it wishes to operate in the Union and has submitted to ESMA proof of its authorisation or registration as an ESG rating provider, the documents required for such authorisation or registration in the third country concerned, as well as the name of the third-country competent authority responsible for its supervision, and has received confirmation from ESMA as regards the completeness of the information provided;

(c)

the Commission has adopted an equivalence decision pursuant to paragraph 2;

(d)

the cooperation arrangements referred to in paragraph 4 are operational.
