15. In order to assess a situation in which an institution has exceeded the limits of Article …
In order to assess a situation in which an institution has exceeded the limits of Article 395(1) of Regulation (EU) No 575/2013, a competent authority should evaluate at least the following aspects: - a. Frequency and number of breaches.
- b. Predictability of the breach.
- c. Reasons beyond control of the institution that led to inability to prevent the breach.
