Identifikace skutečných majitelů subjektů kolektivního investování

Odchylně od čl. 51 prvního pododstavce a čl. 58 odst. 1 jsou skutečnými majiteli subjektů kolektivního investování fyzické osoby, které splňují jednu nebo více z těchto podmínek:

a) 

přímo či nepřímo drží 25 % nebo více podílových jednotek v subjektu kolektivního investování;

b) 

jsou schopny definovat nebo ovlivnit investiční politiku subjektu kolektivního investování;

c) 

ovládají činnosti subjektu kolektivního investování jinými prostředky.
