1. Ħarsa ġenerali

,
Titlu Regolamentazzjoni
Artikolu 43 1.

Għas-sistemi tal-IA b’riskju għoli elenkati fl-Anness III, il-punt 1, jekk meta kien qed juri l-konformità ta’ sistema tal-IA b’riskju għoli mar-rekwiżiti stipulati fit-Taqsima 2, il-fornitur applika standards armonizzati msemmija fl-Artikolu 40 jew, meta applikabbli, l-ispeċifikazzjonijiet komuni msemmija fl-Artikolu 41, il-fornitur għandu jagħżel waħda mill-proċeduri ta’ valutazzjoni tal-konformità li ġejjin abbażi ta’:

(a)

il-kontroll intern imsemmi fl-Anness VI; jew

(b)

il-valutazzjoni tas-sistema ta’ ġestjoni tal-kwalità u l-valutazzjoni tad-dokumentazzjoni teknika, bl-involviment ta’ korp notifikat, imsemmija fl-Anness VII.

Meta juri l-konformità ta’ sistema tal-IA b’riskju għoli mar-rekwiżiti stipulati fit-Taqsima 2, il-fornitur għandu jsegwi l-proċedura tal-valutazzjoni tal-konformità stipulata fl-Anness VII fejn:

(a)

ma jeżistux standards armonizzati kif imsemmija fl-Artikolu 40 u l-ispeċifikazzjonijiet komuni msemmija fl-Artikolu 41 ma jkunux disponibbli;

(b)

il-fornitur ma jkunx applika, jew applika biss parti, mill-istandard armonizzat;

(c)

l-ispeċifikazzjonijiet komuni msemmija fil-punt (a) jkunu jeżistu iżda l-fornitur ma jkunx applikahom;

(d)

wieħed jew aktar mill-istandards armonizzati msemmija fil-punt (a) ikunu ġew ippubblikati b’restrizzjoni u biss fuq il-parti tal-istandard li kienet ġiet ristretta.

Għall-finijiet tal-proċedura ta’ valutazzjoni tal-konformità msemmija fl-Anness VII, il-fornitur jista’ jagħżel kwalunkwe wieħed mill-korpi notifikati. Madankollu, meta s-sistema tal-IA b’riskju għoli tkun maħsuba biex titqiegħed fis-servizz minn awtoritajiet tal-infurzar tal-liġi, tal-immigrazzjoni jew tal-ażil jew minn istituzzjonijiet, korpi, uffiċċji jew aġenziji tal-Unjoni, l-awtorità tas-sorveljanza tas-suq imsemmija fl-Artikolu 74(8) jew (9), kif applikabbli, għandha taġixxi bħala korp notifikat.

Artikolu 43 2.
Għas-sistemi tal-IA b’riskju għoli msemmija fl-Anness III, il-punti 2 sa 8, il-fornituri għandhom isegwu l-proċedura tal-valutazzjoni tal-konformità bbażata fuq il-kontroll intern kif imsemmi fl-Anness VI, li ma tipprevedix l-involviment ta’ korp notifikat.
Artikolu 43 3.
Għas-sistemi tal-IA b’riskju għoli koperti mil-leġiżlazzjoni tal-Unjoni dwar l-armonizzazzjoni elenkata fit-Taqsima A tal-Anness I, il-fornitur tas-sistema għandu jimxi mal-proċedura rilevanti ta’ valutazzjoni tal-konformità kif meħtieġa f’konformità mal-leġiżlazzjoni tal-Unjoni dwar l-armonizzazzjoni rilevanti. Ir-rekwiżiti stipulati fit-Taqsima 2 ta’ dan il-Kapitolu għandhom japplikaw għal dawk is-sistemi tal-IA b’riskju għoli u għandhom ikunu parti minn dik il-valutazzjoni. Għandha ssir ukoll valutazzjoni tas-sistema ta’ ġestjoni tal-kwalità stabbilita fl-Artikolu 17, u l-punti 3, 4.3, 4.4. u 4.5, il-ħames paragrafu tal-punt 4.6 u l-punt 5 tal-Anness VII għandhom japplikaw.

Għall-finijiet ta’ dik il-valutazzjoni tal-konformità, il-korpi notifikati li jkunu ġew notifikati skont il-leġiżlazzjoni tal-Unjoni dwar l-armonizzazzjoni elenkata fit-Taqsima A tal-Anness I għandu jkollhom is-setgħa li jivvalutaw il-konformità tas-sistemi tal-IA b’riskju għoli mar-rekwiżiti stipulati fit-Taqsima 2 ta’ dan il-Kapitolu, diment li l-konformità ta’ dawk il-korpi notifikati mar-rekwiżiti stabbiliti fl-Artikolu 31(4), (5), (10) u (11) ikunu ġew ivvalutati fil-kuntest tal-proċedura ta’ notifika f’konformità mal-leġiżlazzjoni rilevanti tal-Unjoni dwar l-armonizzazzjoni, li hija evidenzjata permezz ta’ valutazzjoni bħala parti min-notifika eżistenti. Mingħajr preġudizzju għall-Artikolu 28, tali korpi notifikati li jkunu ġew notifikati skont il-leġiżlazzjoni tal-Unjoni dwar l-armonizzazzjoni fit-Taqsima A tal-Anness I, għandhom japplikaw għad-deżinjazzjoni f’konformità mat-Taqsima 4 ta’ dan il-Kapitolu sat-28 ta’ Jannar 2028.

Meta leġiżlazzjoni tal-Unjoni dwar l-armonizzazzjoni elenkata fit-Taqsima A tal-Anness I tkun tipprovdi lill-manifattur tal-prodott b’għażla li jiddependi fuq valutazzjoni tal-konformità li ma tinvolvix parti terza, diment li dak il-manifattur ikun applika l-istandards armonizzati biex jiżgura konformità mar-rekwiżiti rilevanti kollha, dak il-manifattur jista’ juża dik l-alternattiva biss jekk ikun applika wkoll standards armonizzati jew, meta applikabbli, l-ispeċifikazzjonijiet komuni msemmija fl-Artikolu 41, li jkopru r-rekwiżiti kollha stipulati fit-Taqsima 2 ta’ dan il-Kapitolu. Il-klassifikazzjoni ta’ prodott bħala sistema tal-IA b’riskju għoli f’konformità mal-Artikolu 6(1) ma taffettwax l-għażla tal-proċedura ta’ valutazzjoni tal-konformità pprovduta lill-manifatturi tal-prodotti koperti mil-leġiżlazzjoni tal-Unjoni dwar l-armonizzazzjoni elenkata fit-Taqsima A tal-Anness I, inkluż, meta applikabbli, għażla li wieħed jibbaża fuq standards armonizzati. Il-manifatturi ta’ tali prodotti mhumiex meħtieġa jagħżlu proċedura ta’ valutazzjoni tal-konformità li tinvolvi valutazzjoni tal-konformità minn parti terza minħabba biss li l-prodott jinkludi sistema tal-IA b’riskju għoli bħala komponent tas-sikurezza, jekk dan ma jkunx meħtieġ mil-leġiżlazzjoni tal-Unjoni dwar l-armonizzazzjoni elenkata fit-Taqsima A tal-Anness I.

Meta sistema tal-IA b’riskju għoli tkun koperta mil-leġiżlazzjoni tal-Unjoni dwar l-armonizzazzjoni elenkata fit-Taqsima A tal-Anness I u tkun ukoll taqa’ f’xi waħda mill-kategoriji elenkati fl-Anness III, il-fornitur ta’ dik is-sistema għandu jimxi mal-proċedura rilevanti ta’ valutazzjoni tal-konformità kif meħtieġ skont il-leġiżlazzjoni rilevanti tal-Unjoni dwar l-armonizzazzjoni elenkata fit-Taqsima A tal-Anness I.

SCR-CMM

Level 0 Not Performed

Practices are non-existent, based on the inability to demonstrate an implemented and operational capability. A reasonable person would conclude the control is not being performed.

Level 1 Performed Informally

SCR-CMM Level 1 criteria definitions are not available for this control:
▪ A reasonable person would conclude this control requires a structured process.
▪ At this level of maturity, the "ad hoc" nature of performing a capability informally would indicate the intent of the control is not met due to a lack of consistency and formality.

Level 2 Planned Tracked

Compliance (CPL) capabilities are requirements-driven, but are not standardized across the entity (e.g., local/regional level consistency). Capability criteria associated with this control reasonably expect the following criteria to exist:
▪ Policies and standards associated with CPL domain capabilities are formally documented and centrally-managed by the entity.
▪ Standardized Operating Procedures (SOP) associated with CPL domain capabilities are documented and maintained by process owners.
▪ IT and/or cybersecurity personnel work with business stakeholders and process owners to appropriately scope and reasonably implement cybersecurity and data protection controls associated with CPL domain capabilities to address applicable statutory, regulatory and/or contractual requirements for Technology Assets, Applications, Services and/or Data (TAASD).
▪ Compliance management controls-related controls are primarily administrative and preventative in nature (e.g., policies, standards and procedures & guidelines).
▪ Compliance management may be a defined function (e.g., team or department) or assigned as an additional duty to existing IT and/or cybersecurity personnel.
▪ External compliance requirements for cybersecurity and data privacy are identified and documented, based on applicable laws, regulations and contractual obligations.
▪ IT and/or cybersecurity personnel work with business stakeholders and process owners to assigned cybersecurity and/or data protection controls to comply with specific compliance requirements.

Level 3 Well Defined

Compliance (CPL) capabilities are standardized across the entity for applicability to People, Processes, Technologies, Data and/or Facilities (PPTDF) to ensure consistency for Technology Assets, Applications, Services and/or Data (TAASD). Capability criteria associated with this control reasonably expect the following criteria to exist:
▪ Policies and standards associated with CPL domain capabilities are formally documented and centrally-managed by the entity's Governance, Risk & Compliance (GRC) team, or similar function.
▪ Standardized Operating Procedures (SOP) associated with CPL domain capabilities are well-documented and kept current by process owners.
▪ A Governance, Risk & Compliance (GRC) team, or similar function, is appropriately staffed and supported to implement and maintain CPL domain capabilities.
▪ Technology is leveraged to enhance the efficiency and accuracy of governance, risk management and compliance operations (e.g., GRC platform).
▪ The entity's Governance, Risk & Compliance (GRC) team, or similar function, works with business stakeholders and process owners to appropriately scope and reasonably implement cybersecurity and data protection controls associated with CPL domain capabilities to address Minimum Compliance Requirements (MCR) (e.g., applicable statutory, regulatory and/or contractual requirements) and Discretionary Security Requirements (DSR) (e.g., entity-required controls).
▪ An implemented and operational capability exists to conduct assessments to demonstrate security, compliance and/or resilience capability conformity with applicable cybersecurity and data protection laws, regulations and/or contractual obligations.

Level 4 Quantitatively Controlled

Utilize SCR-CMM Level 3 criteria definitions:
▪ There are no defined Level 4 criteria, since it is reasonable to assume a quantitatively-controlled process is not necessary to operationalize this control.
▪ While it may be possible to develop “metrics-driven” capabilities for this control, the criteria would be organization-specific to define.

Level 5 Continuously Improving

Utilize SCR-CMM Level 3 or Level 4 (if available) criteria definitions:
▪ There are no defined Level 5 criteria, since it is reasonable to assume a continuously-improving process is not necessary to operationalize this control.
▪ Level 5 capabilities should be considered “world-class” where the control builds on Level 4 capabilities, but are continuously improving through Artificial Intelligence (AI) and/or Machine Learning (ML) technologies.
▪ While it may be possible to develop responsive capabilities for this control through the use of AI and/or ML technologies, the criteria would be organization-specific to define.
