Maidir le córais intleachta saorga ardriosca a liostaítear i bpointe 1 d’Iarscríbhinn III, más rud é, agus é á léiriú go gcomhlíonann córas intleachta saorga ardriosca na ceanglais a leagtar amach i Roinn 2, gur chuir an soláthraí i bhfeidhm na caighdeáin chomhchuibhithe dá dtagraítear in Airteagal 40, nó, i gcás inarb infheidhme, na sonraíochtaí coiteanna dá dtagraítear in Airteagal 41, roghnóidh an soláthraí ceann de na nósanna imeachta um measúnú comhréireachta seo a leanas bunaithe ar:
(a)
an rialú inmheánach dá dtagraítear in Iarscríbhinn VI; nó
(b)
an measúnú ar an gcóras bainistíochta cáilíochta agus ar an measúnú ar an doiciméadacht theicniúil, i gcomhar le comhlacht faoina dtugtar fógra, dá dtagraítear in Iarscríbhinn VII.
Agus é á léiriú go gcomhlíonann córas intleachta saorga ardriosca na ceanglais a leagtar amach i Roinn 2, leanfaidh an soláthraí an nós imeachta um measúnú comhréireachta a leagtar amach in Iarscríbhinn VII sa chás:
(a)
nach ann do chaighdeáin chomhchuibhithe dá dtagraítear in Airteagal 40, agus nach bhfuil na sonraíochtaí coiteanna dá dtagraítear in Airteagal 41 ar fáil;
(b)
nár chuir an soláthraí an caighdeán comhchuibhithe i bhfeidhm nó nár chuir sé ach cuid den chaighdeán comhchuibhithe i bhfeidhm;
(c)
gur ann do na sonraíochtaí coiteanna dá dtagraítear i bpointe (a), ach nár chuir an soláthraí i bhfeidhm iad;
(d)
gur foilsíodh ceann amháin nó níos mó de na caighdeáin chomhchuibhithe dá dtagraítear i bpointe (a) maille le srian agus ar an gcuid sin amháin den chaighdeán ar cuireadh srian uirthi.
Chun críocha an nós imeachta um measúnú comhréireachta dá dtagraítear in Iarscríbhinn VII, féadfaidh an soláthraí aon cheann de na comhlachtaí faoina dtugtar fógra a roghnú. Ach nuair a bheidh sé beartaithe an córas intleachta saorga ardriosca a bheith á chur i mbun seirbhíse ag údaráis forfheidhmithe dlí, údaráis inimirce nó údaráis tearmainn chomh maith le hinstitiúidí, comhlachtaí, oifigí nó gníomhaireachtaí an Aontais, gníomhóidh an t-údarás faireachais margaidh dá dtagraítear in Airteagal 74(8) nó (9), de réir mar is infheidhme, mar chomhlacht faoina dtugtar fógra.

Maidir le córais intleachta saorga ardriosca a chumhdaítear le reachtaíocht chomhchuibhithe an Aontais a liostaítear i Roinn A d’Iarscríbhinn I, leanfaidh soláthraí an chórais an nós imeachta ábhartha um measúnú comhréireachta de réir mar a cheanglaítear i gcomhréir le reachtaíocht chomhchuibhithe ábhartha an Aontais. Beidh feidhm ag na ceanglais a leagtar amach i Roinn 2 den Chaibidil seo maidir leis na córais intleachta saorga ardriosca sin agus beidh siad mar chuid den mheasúnú sin. Déanfar measúnú freisin ar an gcóras bainistithe cáilíochta a leagtar amach in Airteagal 17 , agus beidh feidhm ag pointí 3, 4.3, 4.4 agus 4.5, an cúigiú mír de phointe 4.6 agus pointe 5 d’Iarscríbhinn VII chomh maith. Chun críocha an mheasúnaithe comhréireachta sin, beidh sé de chumhacht ag comhlachtaí faoina dtugtar fógra ar tugadh fógra fúthu faoi reachtaíocht chomhchuibhithe an Aontais a liostaítear i Roinn A d’Iarscríbhinn I measúnú a dhéanamh ar chomhréireacht córas intleachta saorga ardriosca leis na ceanglais a leagtar amach i Roinn 2, ar choinníoll go ndearnadh measúnú ar chomhlíontacht na gcomhlachtaí faoina dtugtar fógra leis na ceanglais a leagtar síos in Airteagal 31(4), (5), (10) agus (11) i gcomhthéacs an nós imeachta um fhógra a thabhairt faoi reachtaíocht chomhchuibhithe ábhartha an Aontais, a léirítear tríd an measúnú mar chuid den fhógra atá ann cheana. Gan dochar d’Airteagal 28, déanfaidh na comhlachtaí sin faoina dtugtar fógra, ar tugadh fógra fúthu faoi reachtaíocht chomhchuibhithe an Aontais i Roinn A d’Iarscríbhinn I, iarratas ar ainmniú i gcomhréir le Roinn 4 den Chaibidil seo faoin 28 Eanáir 2028. I gcás ina dtugtar rogha do mhonaróir an táirge le reachtaíocht chomhchuibhithe an Aontais a liostaítear i Roinn A d’Iarscríbhinn I brath ar mheasúnú comhréireachta nach mbaineann le tríú páirtí, ar choinníoll gur chuir an monaróir sin na caighdeáin chomhchuibhithe i bhfeidhm chun comhlíonadh na gceanglas ábhartha uile a áirithiú, ní fhéadfaidh an monaróir sin úsáid a bhaint as an rogha sin ach amháin má tá caighdeáin chomhchuibhithe nó, i gcás inarb infheidhme, sonraíochtaí coiteanna dá dtagraítear in Airteagal 41 curtha i bhfeidhm aige freisin, lena gcumhdaítear na ceanglais uile a leagtar amach i Roinn 2 den Chaibidil seo. Ní dhéanann aicmiú táirge mar chóras intleachta saorga ardriosca i gcomhréir le hAirteagal 6(1) difear do rogha an nós imeachta um measúnú comhréireachta atá ar fáil do mhonaróirí táirgí a chumhdaítear le reachtaíocht chomhchuibhithe an Aontais a liostaítear i Roinn A d’Iarscríbhinn I, lena n-áirítear, i gcás inarb infheidhme, rogha brath ar chaighdeáin chomhchuibhithe. Ní cheanglaítear ar mhonaróirí na dtáirgí sin nós imeachta um measúnú comhréireachta a roghnú lena mbaineann measúnú comhréireachta tríú páirtí toisc go n-áirítear sa táirge córas intleachta saorga ardriosca mar chomhpháirt sábháilteachta, agus ar an gcúis sin amháin, mura gceanglaítear amhlaidh le reachtaíocht chomhchuibhithe an Aontais a liostaítear i Roinn A d’Iarscríbhinn I. I gcás ina gcumhdaítear córas intleachta saorga ardriosca le reachtaíocht chomhchuibhithe an Aontais a liostaítear i Roinn A d’Iarscríbhinn I agus ina dtagann sé faoi cheann de na catagóirí a liostaítear in Iarscríbhinn III, leanfaidh soláthraí an chórais sin an nós imeachta ábhartha um measúnú comhréireachta mar a cheanglaítear faoi bhun reachtaíocht chomhchuibhithe ábhartha an Aontais a liostaítear i Roinn A d’Iarscríbhinn I.

Conformity Assessment
Description
Mechanisms exist to conduct assessments to demonstrate security, compliance and/or resilience capability conformity with applicable cybersecurity and data protection laws, regulations and/or contractual obligations.
Possible Solutions & Considerations
Micro-Small Business (<10 staff) / BLS Firm Size Classes 1-2
∙ Document applicable regulatory requirements in a checklist
Small Business (10-49 staff) / BLS Firm Size Classes 3-4
∙ Compliance checklist ∙ Annual compliance review
Medium Business (50-249 staff) / BLS Firm Size Classes 5-6
∙ Compliance management program ∙ Regulatory mapping ∙ Compliance calendar
Large Business (250-999 staff) / BLS Firm Size Classes 7-8
∙ GRC solution (e.g., SCFConnect, Cyturus, SureCloud, SimpleRisk, Ignyte, ZenGRC, Galvanize, MetricStream, Archer, etc.) ∙ Compliance team
Enterprise (> 1,000 staff) / BLS Firm Size Class 9
∙ GRC solution (e.g., SCFConnect, Cyturus, SureCloud, SimpleRisk, Ignyte, ZenGRC, Galvanize, MetricStream, Archer, etc.) ∙ Dedicated compliance team ∙ Automated compliance monitoring
SCR-CMM
Level 0 Not Performed
Practices are non-existent, based on the inability to demonstrate an implemented and operational capability. A reasonable person would conclude the control is not being performed.
Level 1 Performed Informally
SCR-CMM Level 1 criteria definitions are not available for this control: ▪ A reasonable person would conclude this control requires a structured process. ▪ At this level of maturity, the "ad hoc" nature of performing a capability informally would indicate the intent of the control is not met due to a lack of consistency and formality.
Level 2 Planned Tracked
Compliance (CPL) capabilities are requirements-driven, but are not standardized across the entity (e.g., local/regional level consistency). Capability criteria associated with this control reasonably expect the following criteria to exist: ▪ Policies and standards associated with CPL domain capabilities are formally documented and centrally-managed by the entity. ▪ Standardized Operating Procedures (SOP) associated with CPL domain capabilities are documented and maintained by process owners. ▪ IT and/or cybersecurity personnel work with business stakeholders and process owners to appropriately scope and reasonably implement cybersecurity and data protection controls associated with CPL domain capabilities to address applicable statutory, regulatory and/or contractual requirements for Technology Assets, Applications, Services and/or Data (TAASD). ▪ Compliance management controls-related controls are primarily administrative and preventative in nature (e.g., policies, standards and procedures & guidelines). ▪ Compliance management may be a defined function (e.g., team or department) or assigned as an additional duty to existing IT and/or cybersecurity personnel. ▪ External compliance requirements for cybersecurity and data privacy are identified and documented, based on applicable laws, regulations and contractual obligations. ▪ IT and/or cybersecurity personnel work with business stakeholders and process owners to assigned cybersecurity and/or data protection controls to comply with specific compliance requirements.
Level 3 Well Defined
Compliance (CPL) capabilities are standardized across the entity for applicability to People, Processes, Technologies, Data and/or Facilities (PPTDF) to ensure consistency for Technology Assets, Applications, Services and/or Data (TAASD). Capability criteria associated with this control reasonably expect the following criteria to exist: ▪ Policies and standards associated with CPL domain capabilities are formally documented and centrally-managed by the entity's Governance, Risk & Compliance (GRC) team, or similar function. ▪ Standardized Operating Procedures (SOP) associated with CPL domain capabilities are well-documented and kept current by process owners. ▪ A Governance, Risk & Compliance (GRC) team, or similar function, is appropriately staffed and supported to implement and maintain CPL domain capabilities. ▪ Technology is leveraged to enhance the efficiency and accuracy of governance, risk management and compliance operations (e.g., GRC platform). ▪ The entity's Governance, Risk & Compliance (GRC) team, or similar function, works with business stakeholders and process owners to appropriately scope and reasonably implement cybersecurity and data protection controls associated with CPL domain capabilities to address Minimum Compliance Requirements (MCR) (e.g., applicable statutory, regulatory and/or contractual requirements) and Discretionary Security Requirements (DSR) (e.g., entity-required controls). ▪ An implemented and operational capability exists to conduct assessments to demonstrate security, compliance and/or resilience capability conformity with applicable cybersecurity and data protection laws, regulations and/or contractual obligations.
Level 4 Quantitatively Controlled
Utilize SCR-CMM Level 3 criteria definitions: ▪ There are no defined Level 4 criteria, since it is reasonable to assume a quantitatively-controlled process is not necessary to operationalize this control. ▪ While it may be possible to develop “metrics-driven” capabilities for this control, the criteria would be organization-specific to define.
Level 5 Continuously Improving
Utilize SCR-CMM Level 3 or Level 4 (if available) criteria definitions: ▪ There are no defined Level 5 criteria, since it is reasonable to assume a continuously-improving process is not necessary to operationalize this control. ▪ Level 5 capabilities should be considered “world-class” where the control builds on Level 4 capabilities, but are continuously improving through Artificial Intelligence (AI) and/or Machine Learning (ML) technologies. ▪ While it may be possible to develop responsive capabilities for this control through the use of AI and/or ML technologies, the criteria would be organization-specific to define.
